These Terms of Service (“Terms”) govern your access to and use of the website <www.divinocandles.com> (the “Site”) and any purchase of products (“Products”) sold by Divino Candles (“Company”, “we”, “us” or “our”). By visiting the Site, placing an order, or clicking “I agree”, you accept and agree to follow these Terms as well as our Privacy Policy and Return & Refund Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be (a) at least 18 years old and (b) legally capable of entering a binding contract under the Indian Contract Act 1872 to buy from us. We sell only within India; we may refuse service or cancel orders at our sole discretion.

2. Account & Site Use

You agree to provide true, current and complete information, keep your login secure, and accept responsibility for all activities under your account. The Site is for personal, non-commercial use only; copying or scraping any part of it is prohibited.

3. Products & Order Acceptance

All Products are handcrafted; slight colour or scent variations are normal (see Return Policy). Your order is an offer; we accept only when we email an “Order Shipped” confirmation. We may limit or cancel quantities to prevent reselling, suspected fraud, or supply issues.

4. Pricing, Taxes & Payment

Prices are listed in Indian Rupees and include GST unless stated otherwise. We can change prices any time before you checkout. By ordering, you authorise us (or our payment partners) to charge your selected payment method for the total displayed.

 

5. Shipping, Risk of Loss & Title

We dispatch within the timeframe shown at checkout; delays beyond our control (weather, carrier strikes) are not breaches. Title and risk pass to you once the package is handed to the carrier.

6. Returns & Refunds

All sales are final except for the statutory exceptions in the Consumer Protection Act 2019 and the E-Commerce Rules 2020—namely, damaged, defective, spurious, late-delivered, or “not-as-advertised” goods. Our detailed procedure and 48-hour window for raising such issues are set out in the Return & Refund Policy, which forms part of these Terms.

7. Intellectual Property

The Site and all content (text, graphics, logos, product images, videos, code) are owned by Divino Candles or its licensors and protected by Indian IP laws. You may not copy, distribute, reverse-engineer, or create derivative works without written permission.

8. User Content (Reviews, Photos, etc.)

If you submit ratings, reviews, images, or other content (“User Content”) you:

·         warrant it is accurate, lawful, and non-infringing.

·         grant us a world-wide, royalty-free, perpetual licence to use, display, adapt, and translate it for marketing or other purposes; and

·         waive any moral rights you may have in that content.

9. Prohibited Conduct

You agree not to:

1.      Use the Site for any fraudulent, defamatory, obscene, or illegal purpose.

2.      Post or transmit malware, spam, or unauthorised commercial messages.

3.      Impersonate another person or violate anyone’s privacy.

4.      Collect other users’ data without consent; or

5.      Attempt to undermine the Site’s security or functionality.

10. Allergy & Safety Disclaimer

Soy wax and fragrance oils can trigger allergies in sensitive individuals. Always perform a patch test with melted wax, burn candles away from flammable materials, and follow the safety label. We are not liable for misuse contrary to the burn instructions delivered with each Product.

11. Warranty Disclaimer

Except for the statutory warranties under Indian consumer law, Products and the Site are provided “as is” without any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Divino Candles shall not be liable for indirect, punitive, incidental, special, or consequential losses (including lost profits, data, goodwill, or business interruption) arising from your use of the Site or Products, even if advised of the possibility. Our total liability for any claim shall not exceed the amount you paid for the relevant order.

13. Indemnity

You agree to indemnify and hold harmless Divino Candles, its directors, employees, and agents against any third-party claims, damages, or expenses arising from your breach of these Terms, your misuse of the Site, or violation of applicable law.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India. For any dispute that cannot be resolved amicably within 30 days, the courts at Noida, Uttar Pradesh shall have exclusive jurisdiction.

In accordance with the Consumer Protection (E-Commerce) Rules 2020 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, we have appointed a Grievance Officer:

We will acknowledge complaints within 48 hours and attempt to resolve them within one month.

16. Modifications to Terms or Site

We may update these Terms or any part of the Site at any time by posting revised terms and updating the “Last updated” date. Continued use of the Site after changes means you accept the revised Terms.

17. Severability

If any provision is determined invalid or unenforceable, the remainder of the Terms shall continue in effect.
